Ann Vargas (Ann) appeals from the decree dissolving her marriage to Javier Vargas (Javier). She argues the district court erred in determining the date of the valuation of the marital estate in the dissolution of the marriage, and erred in the manner in which it divided the property. She also argues the trial court abused its discretion in the amount awarded to Javier as alimony.
We find the district court erred in determining the valuation date for the marital estate. The date used should have been the date of trial. As the parties had an agreement in July 2001 on what to divide the property, we find no abuse of discretion in the distribution of the property. We affirm the dissolution of the marriage, reverse the valuation of the marital estate, and remand for entry of judgment in accordance with this opinion.
Ann and Javier were married in June 1998 and separated in March 2001. A petition for dissolution was filed in June 2001. At the time of the trial in May 2002, Ann was forty-three years of age and Javier was forty-four years old. Ann had three children from a prior marriage. Ann’s income was in the amount of $71,935, and Javier’s income was in the amount of $54,721.
In determining the valuation of the marital estate, the district court set the date of the valuation as the date of trial. The court found the parties agreed the property had an approximate value of $400,000, which would be split equally between them. The court further found the property had a value of $290,000 on the date of trial.
In dividing the property, the court determined that both the real estate and the farming equipment should be evenly split between Ann and Javier. Ann was awarded as alimony the sum of $5,000 per month, and was ordered to pay Javier’s attorney fees in the amount of $
